Prime CS addresses lawmakers' concerns over detention of Kenyans abroad

Prime Cabinet Secretary and Cabinet Secretary for Foreign and Diaspora Affairs, H.E. Musalia Mudavadi has called upon Members of Parliament to actively participate in civic education initiatives targeting Kenyans travelling to and seeking employment in foreign countries.

The Prime CS made this appeal while addressing the National Assembly during Question Time, responding to a query raised by West Mugirango MP, Hon Stephen Mogaka. Hon. Mogaka sought clarification on the government's measures to safeguard Kenyan citizens abroad, following the arrest of Mr. Chris Anyuga Barake in India on October 6, 2023, on allegations of online fraud.

In his response, Dr. Mudavadi highlighted a significant demographic challenge where many Kenyans travel to foreign nations without adequate understanding of the countries' laws. He revealed that over 1,000 Kenyans are currently incarcerated in various countries for offenses, some minor and others serious.

"It is not our wish to see these Kenyans languishing in various places," stated the Prime CS. "I would like to urge that as leaders, we must engage in a collective campaign to convey messages of awareness, especially to the young people."

Dr. Mudavadi emphasized that approximately 70% of affected individuals are young people who often lack crucial information about potential legal consequences. He stressed that it is the collective responsibility of leaders to ensure all Kenyans intending to travel abroad are well-informed.

"For Kenyans in conflict with the law, the Missions facilitates them with the services of a translator, more so in non-English speaking countries to ensure they understand the court proceedings," said the Prime CS

Hon. Mudavadi added that "In certain cases, Mission staff attend court hearings. While they do not offer legal representation, they monitor the cases to ensure the right to a fair trial is not violated, and keep their families updated on progress."

He further underscored the potentially devastating and isolating nature of legal troubles in a foreign land, noting the critical time lag that can occur before assistance from home becomes available. "Time in such cases is critical, by the time loved ones back home realize it, it may be too late to help," he cautioned.

However, Dr. Mudavadi assured the House that the Government is actively working to protect the rights and welfare of Kenyans working abroad through various agreements and ongoing negotiations.

"We have also introduced mobile consular services and outreach programs to reach more Kenyans in remote areas far from our embassies. Additionally, the Department of Diaspora Affairs has developed a legal aid and information framework to equip Kenyans going abroad with essential information about their destination country," the CS added.
