National Assembly votes to proceed with Boda Boda bill despite senate request to halt consideration

The Public Transport (Motorcycle Regulation) Bill, Senate Bill No. 38 of 2023, is set to proceed for consideration by the Committee on Transport and Infrastructure after the National Assembly voted to reject a request by its sponsor, Senator (Dr.) Boni Khalwale to have the withdrawn, citing "widespread public outcry regarding some of the provisions of the Bill."
"The Nays have it, so the Bill will now proceed to second reading at an appropriate time," Speaker Wetang’ula stated.
The Bill popularly known as the Bodaboda Bill was passed by the Senate on 4th December 2024 and was subsequently transmitted to the National Assembly, where it underwent its First Reading on 7th March 2025.
The Bill seeks to introduce a regulatory framework governing the operation of motorcycles, commonly known as bodabodas, at the county level.
In a Communication to the House on 22nd April 2025, the Speaker of the National Assembly, Hon. Moses Wetang’ula informed Members that the Senate had formally requested the cessation of further consideration of the Bill.
“Honourable Members, if you recall, the Bill from the Senator for Kakamega seeks to introduce regulation and bring order to the bodaboda sector. He has since written to this House requesting its withdrawal, despite the Bill having already passed through the Senate,” stated the Speaker.
Following the vote, the Bill will now proceed to the Departmental Committee on Transport and Infrastructure for public participation and the Second reading stage there after in accordance with the provisions of Standing Order 127(5).
